Terms of Service - NexusBot & TOMPA Ecosystem
Effective Date: July 22, 2026
These Terms of Service ("Terms") govern your use of NexusBot, the TOMPA web dashboard, the Command Store, and any associated digital services (collectively, the "Service"), operated by TOMPA ("TOMPA", "we", "us"), founded by Meir Haim Zano.
1. Agreement to Terms
By using NexusBot, the TOMPA web dashboard, or any associated digital services, you agree to be fully bound by these Terms and by Discord's own Terms of Service and Community Guidelines, which apply to your use of Discord itself. If you do not agree, you must immediately remove the bot from your server and cease use of the dashboard interface.
2. Use of Service & Restrictions
- Eligibility: You must be at least 13 years old (or the minimum legal age required in your country, if higher) to access or utilize this Service, and must otherwise be permitted to use Discord under its own Terms of Service.
- Prohibited Actions: You are strictly prohibited from flooding or spamming application commands to induce bot instability, attempting to stress test or attack our cloud infrastructure, using the Service to distribute malicious code or content that violates Discord's Community Guidelines or applicable law, or attempting to bypass administrative security controls built into our systems.
3. Dashboard & Administrative Accountability
Warning: The Server Owner assumes full legal and technical responsibility for all system modifications executed via the TOMPA Dashboard. While we provide configuration histories, we are not liable for actions taken by your server staff who abuse their allocated access permissions.
- The infrastructure developer reserves the right to review any connected server's system configuration strictly for database troubleshooting, security auditing, stability checks, and technical support requests.
4. Premium Services, Billing & Subscription Terms
Our premium features operate on both a one-time payment structure and ongoing subscription cycles handled by our authorized Merchant of Record:
- Payment Processing: All transaction processing is managed securely through Dodo Payments. TOMPA never retains, processes, or has access to your raw payment method details.
- Verification & Fraud Prevention: Users must provide a valid email address for validation before checkouts are authorized. Any attempt to pass fraudulent payments will result in an immediate account and license blacklist.
- Refund Policy: All sales of non-tangible, digital licensing goods and recurring subscription tiers are final. No refunds will be issued once digital services are provisioned, except where required by applicable consumer-protection law.
- Chargebacks & Disputes: Initiating a chargeback or payment dispute without first contacting our support channel will trigger immediate suspension of your licensed tiers, user profile, and all associated Discord servers from the bot network, pending resolution.
- Premium Feature Continuity: Premium features (including but not limited to Anti-Nuke protection, extended activity history retention, the custom help system, and the XP/leveling system) remain active only for the duration of a valid, active subscription. If a subscription is not renewed on time, expires, is cancelled, or otherwise lapses for any reason, all premium features will automatically deactivate on the affected server(s) and the server will revert to free-tier functionality. TOMPA is not responsible or liable for any disruption, loss of protection, loss of functionality, or any resulting consequences arising from the expiration, cancellation, or non-renewal of a premium subscription. Server Owners are responsible for monitoring their subscription status and renewing it in advance if continuous premium coverage is required.
5. Command Store & Intellectual Property
"NexusBot", its logo, dashboard, and underlying software are the property of TOMPA. This section governs user-created content:
- Your Content: You retain ownership of custom commands, configurations, and text you create or import through the Command Store. By publishing content to the Command Store, you grant TOMPA a non-exclusive, royalty-free license to host, display, distribute, and allow other users to import that content within the Service.
- Content Standards: You are responsible for ensuring any content you submit does not infringe third-party rights, contain malicious code, or violate Discord's Community Guidelines or applicable law.
- Moderation: We reserve the right to remove, reject, or delist any Command Store submission at our discretion, including for violations of these Terms, without prior notice.
6. AI Assistant ("NEXUS")
The Service includes an optional AI-powered assistant to help you draft custom commands.
- Suggestions generated by the AI assistant are provided on an "as-is" basis and may be inaccurate, incomplete, or unsuitable for your use case. You are responsible for reviewing and testing any AI-generated configuration before deploying it to a live server.
- Do not submit sensitive, confidential, or unlawful content as a prompt to the assistant.
7. Limitation of Liability & Disclaimer
THE SERVICE IS PROVIDED ON AN 'AS IS' AND 'AS AVAILABLE' BASIS. TOMPA AND ITS FOUNDER EXPRESSLY DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE HELD LIABLE FOR ANY OF THE FOLLOWING:
- Loss, corruption, or modification of Discord servers, user roles, channels, tickets, or general server data.
- Effectiveness of the Anti-Nuke protection system, which depends entirely on the bot's assigned role having sufficiently high permissions and position within your server's role hierarchy. While this system successfully blocks the vast majority of malicious mass-action attempts (approximately 99% of observed cases), if the bot's role lacks sufficient permissions or hierarchy position and resulting damage occurs to your server, TOMPA bears no responsibility for that damage. Server Owners are strongly advised to keep the bot's role positioned as high as reasonably possible.
- Premium systems and features on your server ceasing to function because a subscription was not renewed in time, expired, was cancelled, or otherwise lapsed for any reason - including any resulting loss of protection, moderation capability, or configuration that depended on an active premium subscription.
- Unauthorized administrative server access resulting from compromised Discord application tokens or compromised personal staff accounts.
- Any direct, indirect, or incidental financial or operational damages arising from software downtime, third-party API latency (including Discord's own API), or platform bugs.
- Outcomes resulting from reliance on AI-generated suggestions produced by the NEXUS assistant.
8. Termination & Suspension
We may suspend or terminate your access to the Service, remove the bot from your server, or restrict dashboard functionality at our discretion where we reasonably believe these Terms, Discord's rules, or applicable law have been violated, or in cases of fraud or abuse of the platform. Where practical, we will attempt to notify you of the reason. You may stop using the Service at any time by removing the bot from your server(s).
9. Indemnification
You agree to indemnify and hold harmless TOMPA and its founder from any claims, losses, liabilities, or expenses (including reasonable legal fees) arising from your use of the Service or your violation of these Terms.
10. Governing Law & Dispute Resolution
These Terms are intended to be interpreted in good faith and do not designate a specific court or jurisdiction. Before pursuing any formal claim, you agree to first contact our support channel (Section 12) to attempt an informal resolution. Nothing in this section limits any statutory consumer-protection rights you may have under the mandatory law of your place of residence, which cannot be waived by contract.
11. Changes to These Terms
We may revise these Terms at any time by posting an updated version on this page with a new Effective Date. Material changes will be highlighted where practical. Continuing to use the Service after a revision takes effect constitutes acceptance of the updated Terms.
12. Force Majeure, Severability & Entire Agreement
- Force Majeure: We are not responsible for delays or failures in the Service caused by events beyond our reasonable control, including outages of Discord, our cloud or payment providers, or other third-party infrastructure.
- Severability: If any provision of these Terms is found unenforceable, the remaining provisions continue in full force.
- Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and TOMPA regarding the Service.
13. Global Deletion Rights & Contact Details
Under comprehensive global data privacy regulations (such as GDPR), users retain full rights to request the manual extraction or permanent destruction of all personal information hosted on our systems. To initiate a deletion request or file an inquiry, contact the lead infrastructure developer:
